Shopper sues supermarket after fall

A customer is suing the owners of a New Orleans supermarket, claiming they are responsible for a fall.

Delia Rodriguez filed the lawsuit against The Travelers Insurance Co., The Phoenix Insurance Co., Breaux Mart Supermarkets, Inc. and John Doe June 22 in Orleans Parish District Court.

Rodriquez says she was shopping at Breaux Mart Supermarkets' retail store on Magazine Street April 21 when she slipped on - or was caused to fall by - a foreign substance on the floor.

The defendants are accused of maintaining or creating the hazard and failing to remedy and warn of the hazard.

Rodriguez is seeking damages for physical pain and suffering, mental anguish, medical expenses, lost wages, loss of earning capacity, disability, loss of enjoyment of life, court costs and interest.

New Orleans attorney James H. Minge of James Minge & Associates is representing Rodriguez.

Judge Michael G. Bagneris is assigned to the case.
