Slip and fall suit against Harrah's Casino settles

A slip and fall suit against Jazz Casino Company LLC which was set for a June 28 one-day bench trial in Orleans Parish Civil District Court settled June 11, according to a letter sent by the plaintiff attorneys to Judge Paulette Irons.

California resident Melinda Abby was suing Jazz Casino Co. after she slipped and fell while a guest at Harrah's Casino in downtown New Orleans.

New Orleans attorney Michael Ecuyer represented Abby and filed the original petition for damages in June 2006.

New Orleans attorney Drew Ballina represented Jazz Casino Co.

The terms of the settlement were sealed.

In the petition for damages, Abby claimed that she "sustained injuries to her back, right hip, left hand, ankle and neck" and that Jazz Casino Co. was liable "by permitting an unreasonably dangerous condition and/or defective condition to exist on the floors of the premises."

The plaintiff and defendants agreed to a stipulated protective order in November 2006, which stated that the parties mutually agreed to allow certain documents produced by Jazz Casino Co. to remain confidential.

Irons ordered that the case be fixed for a one-day bench trial on April 28.
