Cyclist sues over allegedly dangerous road

A Jefferson Parish resident has filed a lawsuit after falling off his bicycle on Lakeshore Drive in New Orleans.

Calling the road dangerous, Mark Golay filed suit against the Board of Commissioners for the Orleans Levee District, Southeast Louisiana Flood Protection Authority – East and ABC Insurance Co. July 30 in Orleans Parish District Court.

Golay says an unmarked wire barrier that was stretched across the road caused him to fall.

The defendants are accused of negligence, fault and/or strict liability for failing to adequately mark an inherently dangerous condition, failing to warn or remedy the condition, and for failing to provide a safe and hazard-free environment.

Golay is seeking damages for physical pain and suffering, mental pain and suffering, mental anguish, physical impairment and disability, medical expenses, rehabilitation expenses, loss of services, loss of society, loss of enjoyment of life, interest and court costs.

Golay is represented by Metairie attorney Timothy P. Farrelly of Nicaud and Sunseri.

Judge Herbert A. Cade is assigned to the case.
