A Louisiana resident has filed a lawsuit blaming his employer for not providing protective eyewear.
Bernardo Guerrero filed suit against International Offshore Services Sept. 1 in federal court in New Orleans.
The alleged incident occurred Nov. 30, 2008 as Guerrero was helping paint the M/V International Searcher. Guerrero says he got paint in his eyes because he was not provided any safety gear such as a hard hat or protective goggles. Guerrero claims he suffered severe, debilitating and permanent injuries.
The defendant is accused of negligence for failing to provide competent supervision, ordering the Guerrero to perform an unsafe task and failing to provide safety equipment.
Guerrero is seeking damages for physical pain and suffering, mental pain and suffering, loss of earnings, loss of earning capacity, medical expenses, disfigurement, loss of enjoyment of life, permanent disability, maintenance, cure and unearned wages, interest and court costs.
Guerrero is represented by Stephen P. Bruno of Bruno & Bruno in New Orleans.
U.S. District Judge Carl J. Barbier is assigned to the case.
