Seaman sues after tripping over oar

A seaman has filed a lawsuit against his employer for failing to properly supervise the crew after he tripped over an oar.

Leroy Blue filed suit against Omega Protein Corp. F/V Anna and F/V Grand Batture on Oct. 1 in federal court in New Orleans.

The accident occurred on June 1, 2010 as Blue was attempting to move about in rough water. He states he fell over an oar that was not properly secured, causing severe and permanent injuries to his back, head, neck and legs.

Blue also states he was injured in 2009 after he attempted to remove a hatch cover that was too heavy for one man to lift.

The defendant is accused of failing to properly supervise the crew, properly train their employees, provide adequate safety equipment and safely operate their vessel. Blue also accuses the defendants of negligence for operating the vessel with an inadequate crew.
The plaintiff is seeking damages for physical pain, mental anguish, physical impairment, loss of earnings, loss of earning capacity, medical expenses, maintenance and cure, punitive damages, interest, attorneys' fees and court costs.

Blue is represented by Robert P. Wynee, Michael. E. Pierce and Christopher M. Spain of Arnold & Itkin in Houston. A jury trial is requested.

U.S. District Judge Ivan L. R. Lemelle is assigned to the case.
