USPS sued by customer who slips in rain puddle

David T. Davis filed suit against the United States Postal Service on Nov. 9 in federal court in New Orleans after he slipped and fell on a large accumulation of rain water at the entrance to the Hahnville Post Office.

Davis claims he required immediate medical attention for a back injury after the incident happened Dec. 16, 2009.

He claims he was told that it was not unusual for water to accumulate at the entrance and for employees to place wet floor signs and regularly mop the area. An employee stated that she failed to place the wet sign markers out and that she failed to mop the area of accumulation.

Davis is seeking actual damages for pain and suffering, punitive damages, an award of medical damages, costs, interest and attorney's fees.

He is represented by Denise A. Vinet of Vinet & Day in Baton Rouge.

U.S. District Judge Ivan L. R. Lemelle is assigned to the case.
