Winn Dixie sued for $2.5 million over customer's slip and fall

A St. Tammany Parish resident is suing a grocery store for more than $2.5 million after she slipped and fell.

Belinda Pellegrin filed suit against Winn Dixie Montgomery Inc. on Dec. 13 in federal court in New Orleans.

According to the lawsuit, Pellegrin was shopping at the Winn Dixie Store in Marrero on Jan. 30 when she fell due to a foreign substance on the floor.

She argues that Winn Dixie is responsible for her injuries.

Pellegrin states that the defendant is negligent for failing to furnish her with a safe place to shop, for failing to appropriately maintain aisles, for failing to warn customers that the store did not maintain its displays and for failing to properly block off the aisle.

Pellegrin states she suffered a severe and disabling injury to her back and mind due to the incident.

Pellegrin is asking for an award of $2.5 million in damages for mental anguish, physical pain and suffering, lost wages, medical expenses, interest and court costs.

Pellegrin is represented by Thomas M. Discon of Discon Law Firm in Mandeville. A jury trial is requested.

U.S. District Judge Mary Ann Vial Lemmon is assigned to the case.
