Petco sued by woman claiming carpal tunnel-type injuries

A Jefferson Parish resident has filed a lawsuit against Petco Animal Supplies Stores Inc. over an incident at a Kenner store in which she slipped and fell, suffering a carpal tunnel type injury to her hand.

Leona Tuminello filed the suit on Feb. 1 in Jefferson Parish District Court and then the defendant removed the case to federal court in New Orleans.

Tuminello claims that on Sept. 12, 2010, she slipped on display cards and fell to the ground. She injured her neck, back and suffered carpal tunnel to her hand.

Petco is accused of failing to use reasonable and prudent care under the circumstances, failing to properly maintain, inspect and repair the premises, failing to clean the area, failing to have proper lighting and other acts of negligence.

Tuminello is seeking damages for physical pain and suffering, mental anguish, medical expenses, loss of enjoyment of life, lost wages and loss of earning capacity, interest and court costs.

Tuminello is represented by Metairie attorney A.J. Rebennack.

U.S. District Judge Eldon E. Fallon is assigned to the case.
