Slidell Lowe's customer allegedly knocked to ground by palm tree

A St. Tammany Parish resident is suing Lowe's Home Centers, Inc. after a palm tree fell and knocked him to the ground.

Leroy Carter filed suit April 4 in federal court in New Orleans.

On April 12, 2010, Carter was shopping for palm trees at Lowe's Home Center located in Slidell. He states that one of the palm trees fell on him with such extreme force that he fell on the pavement. Carter injured his back, spine and left shoulder in the incident, the suit claims.

According to the lawsuit, Carter did not touch the merchandise that struck him. He states it fell due to improper placement and securing.

Lowe's is accused of negligence for failing to keep its aisles, passageways and floors in a reasonably condition, failing to warn, failing to keep the premises free of a hazardous condition or in a reasonably safe environment, failing to inspect or maintain the premises, and for negligently placing merchandise in an unstable or precarious position.

The plaintiff is seeking damages for physical pain and suffering, mental anguish, medical expenses, interest and court costs.

Carter is represented by Joseph M. Miller, Benjamin B. Saunders and Carisa German-Oden of Davis Saunders in Mandeville.

U.S. District Judge Kurt D. Engelhardt is assigned to the case.
