Winn Dixie sued over woman's slip on water

A New Orleans woman has filed a personal injury lawsuit against Winn Dixie after she slipped in water and fell.

Claiming permanent disability, Doris Galloway filed suit against Winn Dixie Montgomery on March 16 in Orleans Parish District Court. The defendant removed the case to federal court in New Orleans on May 23.

The accident occurred on June 26, 2010 as Galloway was shopping in a New Orleans Winn
Dixie Montgomery. She states she suffered severe and permanent injuries when she slipped and fell due to some water on the floor.

The defendant is accused of negligence for failing to properly maintain the premises, failing to warn patrons of a dangerous condition, failing to properly inspect the premises to identify, remove or repair the dangerous condition and failing to have in effect a proper and adequate safety program.

The plaintiff is seeking damages for physical injuries, emotional upset and distress, medical expenses, lost wages, loss of wage earning capacity, pain and suffering, disability, mental anguish, loss of enjoyment of life, rehabilitation and support care, interest and court costs.

Galloway is represented by Raphael Bickham of The Bickham Law Practice in New Orleans.

U.S. District Judge Kurt D. Engelhardt is assigned to the case.
