New Orleans Wal-Mart sued over leaking air conditioning unit

A New Orleans Wal-Mart store is being sued for negligence by a customer who claims to have slipped in water that was leaking from an air conditioning unit.

William and Cynthia Mason filed suit against Wal-Mart Stores Inc. and ABC Insurance Co. on Aug. 23, 2011 in Orleans Parish District Court.

The defendant removed the case to federal court in New Orleans on Oct. 5.

The alleged incident occurred on Nov. 25, 2010 as William Mason was shopping at a Wal-Mart in New Orleans. He states he was walking, when he slipped in a foreign substance on the floor which caused him to fall and sustain injuries.

Wal-Mart is accused of negligence for failing to use ordinary care and diligence to design, build, keep and maintain the floor area in a condition reasonably safe for its intended use and free from all defects and conditions which would render it dangerous and unsafe.

The plaintiff is seeking damages for pain, suffering, disability, mental anguish, medical expenses, loss of economic income and earning potential, loss of consortium, love, society, services, interest and court costs.
