A commercial diver has filed a lawsuit against his employer after he sustained a decompression illness.
Roger Cook filed suit against Cal Dive International Inc. on Dec. 6 in federal court in New Orleans.
The alleged incident occurred on Nov. 16, 2010, while Cook was employed by the defendant as a seaman and crewmember of the Pipelay/Bury Barge Lone Star, which was conducting commercial dive operations. Cook claims that he sustained central nervous system decompression illness to his vestibular system and inner ear while on a dive.
He accuses the defendant of negligence for failing to implement a safe dive plan, failing to provide proper medical care and treatment, failing to provide a safe and non-hazardous workplace and for failing to provide proper and sufficient tools and manpower to complete the tasks at hand.
Cook is asking the court for an award of damages for injuries, disabilities, medical expenses, maintenance and cure, court costs, interest, and attorney's fees.
The plaintiff is represented by Bobby J. Delise and Alton J. Hall Jr. of Delise & Hall in New Orleans. A jury trial is requested.
U.S. District Judge Ivan L. R. Lemelle is assigned to the case.
