NEW ORLEANS - A Louisiana couple has filed a lawsuit against Pfizer claiming that its antidepressant drug Zoloft causes birth defects while taken during pregnancy.
Terry Rolling and Nelda Rolling, individually and as parents and natural guardians of K.R. a minor child, filed suit against Pfizer Inc. on Jan. 27 in federal court in New Orleans.
Nelda Rolling took the prescription drug Zoloft during her pregnancy with the minor plaintiff. She claims the drug caused the baby to be born with congenital birth defects.
Pfizer is accused of failing to adequately warn of the drug's risks and of concealing, suppressing, and failing to disclose dangers.
The defendant is accused of violations of the Louisiana Products Liability Act and for allegedly violating the warranty of redhibition.
The parents are seeking an award of damages for medical expenses, mental anguish, emotional distress, loss of consortium, companionship, service and society, interest and court costs.
The plaintiffs are represented by James R. Dugan II, Douglas R. Plymale, David Franco and Kevin Oufnac of The Dugan Law Firm in New Orleans. A jury trial is requested.
U.S. District Judge Kurt D. Engelhardt is assigned to the case.
