Company sued for allegedly not honoring warranty in roof failure

NEW ORLEANS – A New Orleans roofing company is being sued for the alleged failure of a roof.

Loconte Partners, LLC filed suit on Feb. 1 in the Orleans Parish Civil District Court against Montgomery and Associates.

Loconte claims the defendant repaired the roofs of buildings at its property at West St. Bernard Highway in Chalmette. The defendants are alleged to have given a 10-year no leak guarantee on the repair job in which a spray foam polyurethane system was used to repair the roofs.

The plaintiff claims the warranty was breached after the roofs began leaking just over five years after the repairs were made. Loconte states it notified Montgomery and Associates about the problems numerous times, but the defendants refused to honor the warranty.

An unspecified amount in damages is sought for alleged breach of warranty including increased costs, loss of business, loss of economic opportunity, loss of profits and mental anguish.

Loconte is being represented by New Orleans attorney Lawrence J. Centola, III.

The case has been assigned to Division I Judge Piper D. Griffin.
