Gas station sues Entergy for power surge

NEW ORLEANS – A New Orleans gas station is suing an area energy provider for damages it claims were caused by a power surge.

Super Discount Gas, Inc. filed suit on Feb. 22 in Orleans Parish Civil District Court against Entergy New Orleans, Inc.

The plaintiff alleges a power surge struck the gas station located at 2727 S. Claiborne Ave in New Orleans that resulted in much of the gas station's electronic equipment being ruined.

The plaintiff also alleges that Entergy misrepresented the estimated damage amount at $26,122.06 and also misrepresented the date of the incident so a consumer claim with the company would no longer be eligible for payment.

The defendant is being accused of failing to properly control energy output, failing to maintain electric equipment, failing to protect plaintiff's property from damage, failing to maintain and inspect power lines and failing to properly employ and place surge protectors.

An unspecified amount in damages is sought for compensation, penalties and attorney's fees.

Super Discount Gas, Inc. is being represented by Robert J. Diliberto of Metairie-based Diliberto & Kirin.

The case has been assigned to Division A Judge Tiffany G. Chase.
