NEW ORLEANS – A New Orleans man has filed suit against a property owner and a building supplies rental service for injuries he claimed occurred while renovating a property.
Shane Spence filed suit on April 19 against Mercedes Whitecloud and Industrial Products Limited, LLC in the Orleans Parish Civil District Court.
Spence claims he was descending scaffolding during renovation work at Whitecloud's property when he missed a hand grip and slipped on a wet platform before falling 30 feet to the ground. The plaintiff alleges he received a fractured femur, fractured hip, fractured and dislocated shoulder, fractured right hip, numerous bruises, contusions and abrasions, back strain, mental anguish and emotional stress.
Whitecloud is accused of failing to provide the plaintiff a safe place to work, failing to provide proper training, failing to ensure the scaffolding was safe, faulty hiring, leasing a dangerous scaffold and hiring Spence's employer without ensuring they had scaffold training.
Industrial Products Limited, LLC is accused of providing defective scaffolding and for failing to ensure scaffold users were properly trained.
An unspecified amount in damages is sought for medical expenses, lost wages, loss of earning capacity, pain and suffering, mental anguish, loss of enjoyment of life and permanent residual disability.
Spence is being represented by attorneys Darlene Jacobs of New Orleans and Michael B. Alker of Mandeville.
The case has been assigned to Division J Judge Paul A. Brown.
