NEW ORLEANS – A Utah-based company has filed suit through their New Orleans office against two brothers they claim breached a construction materials contract with them.
Crescent Resources LLC of Utah filed suit on April 20 against Stonehedge Construction, Inc. and its owners Roger and Scott Cull in the Orleans Parish Civil District Court.
Crescent claims the Culls signed a contract that would pay the plaintiff to dump sand on their land, which they were to resell later.
The plaintiff asserts its main business venture is in hauling debris, but that it sells the sand that is hauled away. Crescent alleges the Culls agreed to pay one dollar for each cubic yard of sand deposited on their property. The plaintiff claims it has not received any payment after $107,691 worth of sand has been dumped at the Culls' site.
An unspecified amount in damages is sought for three times the value of the deposited material in addition to attorney's fees and court costs.
Crescent Resources LLC of Utah is being represented by Galen M. Hair of New Orleans-based Varadi, Hair & Checki, LLC.
The case has been assigned to Division D Judge Lloyd J. Medley.
