Truck driver sues after suffering injuries during unloading of truck

NEW ORLEANS - A truck driver has filed a personal injury lawsuit that claims he suffered serious injuries when a customer prematurely released his truck's load.

Joseph Pierre filed suit against Lehigh Hanson Pipe and Hanson Pipe & Precast, John Doe, Liberty Mutual Fire Insurance Co. and XYZ Insurance Co. in Orleans Parish District Court. The defendants removed the case to federal court in New Orleans on May 30.

The alleged incident occurred on Feb. 24, 2011, as Pierre was dispatched to defendant's location on Old Gentilly Road in New Orleans. Pierre states that he was assisting in tying a load of metal forms to a truck, when the defendant's employee prematurely released the load causing Pierre serious injuries.

The defendants are accused of negligence for failing to perform his duties in a safe manner, failing to maintain control of machinery, failing to keep a look-out so as to avoid injury, failing to exercise reasonable care in performance of his job.

The plaintiff is asking the Court for an award of damages for severe, painful and disabling physical and mental injuries, pain and suffering, interest, and court costs.

Pierre is represented by Alfred C. Barrera of Alfred C. Barrera & Associates in Avondale.

U.S. District Judge Nannette Jolivette Brown is assigned to the case.
