Suit filed against road contractor by veterinarian over Causeway road project

GRETNA – A Metairie-based veterinarian is suing a road constructor and a state department for damages he claims happened on his business site due to road construction.

Patrick M. McSweeney and Animal Medical and Surgical Hospital filed suit against James Construction Group, the Louisiana Department of Transportation and Development and their insurers in the 24th Judicial District Court on June 14.

McSweeney claims multiple parties affiliated with James Construction trespassed on his animal hospital's property located at 3001 North Causeway Boulevard in Metairie and damaged it through vibrations emanating from the construction site.

The plaintiff alleges the trespass included the driving and parking of heavy machinery, deterring customers from using the property and the vibratory damage came from pilings driven into the ground nearby.

McSweeney asserts the vibrations resulted in cracked windows and tiles, broken plumbing pipe, damage to the parking lot area, sinking of the ramp leading up to the clinic's front door, the building's awning pulled away from the structure, damages to the telephone system and recalibration of the clinic's scales.

The defendant is accused of negligence because they should have known that its works would cause damage.

An unspecified amount in damages is sought.

The case has been assigned to Division I Judge Nancy A. Miller.
