NEW ORLEANS – A New Orleans adult daycare provider allegedly failed to clean up broken glass in a transport van which led to injuries to a passenger.
Dennis Jackson filed suit against Catholic Charities of the Archdiocese of New Orleans, Catholic Mutual Group and Keith Cavalier in the New Orleans Civil District Court on June 15.
Jackson claims he was a passenger in a van used by the plaintiff to transport elderly individuals to an adult daycare program. The plaintiff alleges that a window had been broken out and the van operator failed to sweep the floor of glass fragments before picking him up.
Jackson asserts that he entered the van without a problem, but later when it stopped as he was standing up he lost his footing and fell. The plaintiff claims he received injuries from falling on the broken glass.
The defendant is accused of creating a dangerous condition, failing to warn of condition, failing to remedy the condition, picking up passengers with danger existing in van and ignoring requests to remedy the condition.
An unspecified amount in damages is sought for medical bills, pain and suffering, mental anguish, inconvenience and loss of enjoyment of life.
