DONALDSONVILLE – A southeastern Louisiana parish has filed suit against an international insurance company claiming a street maintenance company fell short of provisions in a contract.
The Parish of Ascension filed suit against Liberty Mutual Insurance Company and Boone Services LLC in the 23rd Judicial District Court on July 31. Ascension Parish claims Boone agreed to maintain the streets and improvements in parts of the parish for a one year period. The plaintiff alleges the defendants obtained a maintenance surety bond in the amount of $113,346 warranting against all defects in workmanship and materials. The parish asserts that defects in the material became apparent within a 12 month period and thus it should be able to receive funds from the surety bond.
Damages in the amount of $116,346 are requested by the plaintiff.
Ascension Parish is represented by Ascension Parish Assistant District Attorney Lindsey D. Manda.
The case has been assigned to Division D Judge Jessie Leblanc.
Case no. 104,417.
