NEW ORLEANS - An offshore mechanic has filed a lawsuit against his employer that claims they are responsible for the injuries he received when he fell out of a boat's chair when it hit a wake.
Demetris Smith and Starla Smith filed suit against Exterran Entergy Solutions L.P. on July 23 in federal court in New Orleans.
The alleged incident occurred on Jan. 19, 2012 as Demetris Smith was employed as a pipeline mechanic and en route to a rig. He was being transported aboard the crewboat when it hit a wake and he was thrown from his chair. Smith was knocked unconscious and sustained multiple injuries.
The defendant is accused of negligence for failing to properly supervise the employees of Exterran Energy Solutions as to proper procedures aboard the crewboat, allowing and promoting dangerous practices to occur upon the crewboat, failing to operate the crewboat in a safe, secure and effective manner, and for failing to provide a safe place to work.
Smith is asking for more than $1 million in damages for disability, physical and mental pain and anguish, loss of bodily function, embarrassment, loss of society and companionship, loss of financial support, loss of aid and assistance, loss of felicity, interest, and court costs.
