Alabama seaman sues claiming he suffered disabling injuries after falling down stairs

NEW ORLEANS - An Alabama seaman has filed a lawsuit against his employer claiming he suffered disabling injuries when he fell down the stairs on the vessel.

Wayne Bennett filed suit against Swan Marine Operators on July 27 in federal court in New Orleans.

The alleged incident occurred on June 5, 2011, while Bennett was employed as a seaman aboard the M/V Dylan J. Bennett states that he suffered severe and disabling injuries when he fell on the interior stairs of the vessel.

The defendant is accused of negligence for failing to provide a safe place to work, failing to warn of the hazardous conditions, failing to remedy a hazardous condition, failing to warn of the dangerous and unsafe conditions of the vessel, failing to discover and correct the unsafe conditions, creation and maintenance of an unseaworthy vessel, and for failing to properly maintain and repair the vessel and its equipment.

The plaintiff is seeking damages for medical expenses, pains, mental anguish, disability, maintenance, cure, interest, attorney's fees, and court costs.

Bennett is represented by Lawrence Blake Jones and Kristi A. Post of Scheuermann & Jones in New Orleans.

U.S. District Judge Jane Triche Milazzo is assigned to the case.
