Plaintiff's firm sues insurer and former client

NEW ORLEANS – An attorney who represented a client in an automobile accident is suing an insurer due to not receiving settlement funds in that case.

John D. Sileo and the Law Office of John Sileo, Ivory Hall, and Erma Bick have filed suit USA Casualty Insurance Company and Everett Magee in the Orleans Parish Civil District Court on Aug. 2.

Sileo claims his firm negotiated a settlement on behalf of Magee for nearly $11,000 due to an auto accident he was involved in. The plaintiff claims the Medical Center of Louisiana asserted a lien for Magee's treatment for $32,633.56 in unpaid medical bills. Dileo asserts that the settlement cannot go forward because the settlement amount is less than the lien amount.

The defendants are accused of having conflicting claims.

The plaintiff is requesting the court deposit the settlement funds towards the lien and that they should deduct attorney's fees from the deposit in the amount of $1,475.22.

Sileo is representing himself in the case.

The case has been assigned to Division D Judge Lloyd J. Medley.
