Harahan Wal-Mart sued by woman claiming she was hit by pallet jack

GRETNA – A woman is suing a local retailer for injuries she claims to have received due to the negligence of one of its employees.

Sandra L. Bonilla and, her husband, Saul Angelo Martinez filed suit against Wal-Mart Louisiana, LLC and Wal-mart Stores, Inc. in the 24th Judicial District Court on Aug. 13.

Bonilla claims she was shopping with her husband and children at the Wal-Mart located at 5110 Jefferson Hwy. in Harahan when an employee operating a pallet jack ran into her foot. The plaintiff alleges that the collision knocked her shoe off and caused her to fall on the pallet jack and then to the floor. Bonilla asserts she received serious injuries to her right arm, right thigh, cervical spine and lumbar spine.

The defendant is accused of failing to maintain proper control over property in a safe and suitable manner, failing to properly train its employees to use pallet jacks, failing to implement safe usage strategies for pallet jacks, failing to exercise reasonable care over an object in its possession and failing to properly supervise employees.

An unspecified amount in damages is sought for pain and suffering, disability, mental anguish, medical expenses and loss of earning income and earning capacity.

Bonilla is represented by Val Patrick Exnicios of New Orleans-based Liska, Exnicios & Nungesser.

The case has been assigned to Division D Judge Robert M. Murphy.
