Food packaging company sued for not fulfilling contract, causing food spoilage

GRETNA – A Delaware-based food production company is suing a packing company for breach of contract after it was allegedly unable to fulfill an entire order that resulted in food spoilage.

Genovive, LLC filed suit against Sopakco, Inc. in the 24th Judicial District Court on Aug. 15. Genovive claims it entered into an agreement with Sopakco to fulfill a $600,000 to package their food products. The plaintiff claims the defendant was only able to package $525,181.30 of the order and the rest of the unpackaged food went to waste.

The defendant is accused of breach of contract.

Damages in the amount of $126,310.24 plus attorney's fees are sought by the plaintiff.

The case has been assigned to Division J Judge Stephen J. Windhorst.
