GRETNA – A Kenner family is suing a trucking company alleging their home was damaged due to circumstances created when a truck crashed into power poles supplying electricity to their home.
Fred and Carol Ney filed suit against Averitt Express, Inc., Southern Fidelity Insurance Company, an unknown driver and their insurer in the 24th Judicial District Court on Aug. 17. The Neys claim that on Sept. 18, 2011 a truck owned by Averitt Express crashed nearby their home located at 3245 Maryland Ave. in Kenner.
The plaintiffs allege the driver crashed into nearby power poles before fleeing the scene of the accident. The Neys assert that they were shut off from power for two days, which resulted in the heat to rise in their home and floors to buckle, among other things.
The defendant is accused of causing significant property damages to the plaintiff's residence.
An unspecified amount in damages is sought for property damage, additional living expenses and inconvenience.
The Neys are represented by Charles V. Cusimano, II of the New Orleans-based Cusimano Law Firm.
The case has been assigned to Division L Judge Donald A. Rowan.
