NEW ORLEANS – A New Orleans company is suing its landlord for allegedly breaking lease terms by vacating the lease before the contract expired.
501 Rue Decatur, LLC filed suit against VTM Properties, LLC in the Orleans Parish Civil District Court on Sept. 19. 501 Rue Decatur claims it took a ownership of the lease of the second, third, fourth an attic floors of 507 Decatur St. in New Orleans due to a sheriff's sale on Feb. 24, 2011. The plaintiff claims the lease was originally signed in 1993 for a 25-year period to last until 2018. 501 Rue Decatur asserts the defendant accepted and cashed rent checks throughout 2011, but in 2012 accepted the checks without cashing them for nine months. 501 Rue Decatur alleges it received a notice that its lease was being vacated in September 2012.
The defendant is accused of violating the lease agreement.
The plaintiff seeks to have the defendant held to the original terms of the lease.
