Pregnant employee with spina bifida accuses hospital of wrongful termination

GRETNA – A Jefferson Parish woman is suing her former employer for harassment and wrongful termination.

Emily Shinn filed suit against Jefferson Parish Hospital Service District No. 2 and East Jefferson General Hospital in the 24th Judicial District Court on Sept. 24. Shinn claims she was employed by East Jefferson General Hospital (EJGH) which was fully aware of her medical condition of spina bifida and the fact she was pregnant. The plaintiff alleges that she was subjected to discrimination by her fellow employees. Shinn asserts that EJGH terminated her employment after failing to reasonably accommodate her injury or grant her reasonable leave.

The defendant is accused of violating the Louisiana Employment Discrimination Law and the Louisiana Constitution and demonstrating malice and reckless indifference toward the plaintiff's rights.

An unspecified amount in damages is sought for mental anguish, physical pain, back pay, benefits, reinstatement, front pay, reasonable attorney's fees, penalties, punitive damages and court costs.

Shinn is represented by Daniel M. Redman of New Orleans-based Lobman, Carnahan, Batt, Angelle & Nader.

The case has been assigned to Division E Judge John J. Molaison, Jr.
