GRETNA – A Gretna woman is suing a condominium association she belongs to for allegedly depriving her of her property by turning her condominium into a storage unit following Hurricane Katrina.
Linda Chehardy filed suit against Promenade Condominium Association, Inc. in the 24th Judicial District Court on Sept. 25. Chehardy claims that she owns a condominium at Promenade Condominium Association located at 2425 Oxford Place in Gretna.
As a result of suffering from serious medical issues Consuella Kinney has been appointed Chehardy' power of attorney. The plaintiff alleges that while she has continued to pay her monthly condominium dues the locks on her condo unit have been changed and it has been converted to use for storage by the defendant without her authorization following Hurricane Katrina in 2005. Chehardy asserts that her condo was also gutted by the defendant following the storm although it did not suffer any damage. The plaintiff also claims that the property manager for the defendant Bonnie Loftis alleges Chehardy owes the condo association $7,000 for non-payment of condo dues.
The defendant is accused of unlawful eviction and intentional infliction of emotional distress.
The plaintiff seeks for the defendant to vacate the premises and remove all items in the unit belonging to them, restoring the unit and repairing all damages, provide a specific accounting of the alleged delinquency for condo association fees, provide keys for the new locks on the property, provide reimbursement for using the unit for the past seven years and to be found of intentionally inflicting emotional distress.
