Fallen case of jarred pickles leads to work comp insurance suit

NEW ORLEANS – An insurer for a New Orleans grocery store is suing a wholesale grocer for alleged injuries sustained by an employee over a fallen jar of pickles.

Luba Casualty Inc., on behalf of William Schremp is suing C&S Wholesale Grocers Inc. in the Orleans Parish Central District Court on Aug. 15. Luba, the workers' compensation insurer for Rouses, paid benefits to William Schremp, an employee of Rouses, following significant injury to his lower extremities as a result of a case of pickles falling off a pallet while a grocery truck was being unloaded.

The plaintiff claims C&S is liable for Schremp's injuries.

The defendant is accused of failing to properly load, secure, inspect, and transport the pallet from which the pickles fell and failure to reimburse plaintiffs for compensation granted to Schremp.

An unspecified amount is sought for full reimbursement of all payments made by Luba and all other relied found reasonable.

The plaintiff is represented by John A. London III of the Law Office of John A. London, III, APLC.

This case has been assigned to Division L Judge Kern A. Reese.
