Homeowner sued by potential buyer for backing out of deal

Preston L. Hayes

GRETNA – A Jefferson Parish man is suing the homeowner whose home he was going to buy for breaking a contract the two had allegedly agreed upon.

Ezera Raymond, Jr. filed suit against Hollis Fletcher, Jr. in the 24th Judicial District Court on Oct. 9. Raymond claims he entered into a contract to buy Hollis's home located at 400 Baroni Dr. in Kenner. The plaintiff alleges that he and the defendant entered into a contract for sale of the home, but the defendant refused to finalize the Act of Sale and did not show up to the closing of the deal. Raymond asserts that the contract stipulated a penalty in the amount of 10 percent of the home's price in case of a breach of contract.

The defendant is accused of breach of contract.

Damages in the amount of 10 percent of the sale price of the home plus attorney's fees and court costs are sought by the plaintiff.

Raymond is represented by Preston L. Hayes of Metairie-based Chehardy, Sherman, Ellis, Murray, Recile, Griffith, Stakelum & Hayes, LLP.

The case has been assigned to Division E Judge John J. Molaison, Jr.

Case no. 719-871.
