GRETNA – A Jefferson Parish couple is suing their homeowner’s insurance and a plumbing company for damages they allege stem from a repair grated to their home by their insurer.
Leslie S. and Kevin M. Tennison filed suit against Homewise Insurance Company, Louisiana Insurance Guaranty Association, Lighthouse Property Insurance Corporation and All Clear Plumbing Video Drain and Sewer Service, LLC in the 24th Judicial District Court on Oct. 29. The Tennison’s claim that shortly after moving into their Metairie home they found a leak under the concrete foundation that they successfully submitted a claim for to Homewise Insurance Company and was repaired by All Clear Plumbing Video Drain and Sewer Service. The plaintiffs allege after the plumbing contractor replaced the leaking pipe the foundation and walls in their home began to crack due to defective work that was done on the job. The Tennison’s assert that they filed a claim with Homewise who said they would have an adjuster on the property within 72 hours, however, the plaintiffs found out shortly afterward that Homewise’s policies were acquired by Lighthouse Property Insurance Corporation who they allege dnied the claim.
The insurance defendants are accused of unreasonably and intentionally refusing to pay benefits, delaying payments and failing to conduct a reasonable investigation into the claim.
Defendant All Clear Plumbing Video Drain and Sewer Service, LLC is accused of structural damage to the premises, cosmetic damage to the premises, interior damage to the premises, mental anguish, loss of use or enjoyment of premises, attorney’s fees and diminution of value of premises.
An unspecified amount in damages is sought for the cost of repairs.
The Tennison’s are represented by Metairie-based attorney Robert M. Braiwick.
The case has been assigned to Division B Judge Cornelius E. Regan.
