Home Depot sued for residual disability by woman who was allegedly injured after tripping over Christmas tree

GRETNA – A Jefferson Parish woman is suing a local outlet of a national hardware retailer for injuries she claims to have received on its premises.

Shirley Wilkinson filed suit against Home Depot, Inc. in the 24th Judicial District Court on Dec. 3. Wilkinson claims she was shopping at the Home Depot located on Lapalco Boulevard in Marrero when she tripped over a Christmas tree laying in an aisle and fell to the floor. The plaintiff alleges that she was injured in the fall.

The defendant is accused of failing to properly monitor its premises, failing to keep the aisles free of dangerous objects, failing to clear the aisle after noticing the dangerous condition and failing to properly staff a high traffic area during a peak season to ensure the safety of patrons.

An unspecified amount in damages is sought for medical expenses, mental pain and suffering, physical pain and suffering, loss of earnings and residual disability.

Wilkinson is represented by Gretna-based attorney Shelly R. Sessions.

The case has been assigned to Division M Judge Robert M. Pitre, Jr.
