GRETNA – A Jefferson Parish woman is a suing a medical product manufacturer for injuries she claims to have received from the failure of an implant device.
Alva Hubbard filed suit against Advanced Neuromodulation Systems, Inc. and St. Jude Medical, Inc. in the 24th Judicial District Court on Dec. 5. Hubbard claims she had a spinal stimulator implanted in her at a surgical facility in Jefferson Parish. The plaintiff alleges the implant was meant to alleviate back pain, but after it was implanted she continued to have back pain and the device was removed months later. Hubbard asserts she was injured through the implantation and removal of the device.
The defendant is accused of failing to follow FDA guidelines, failing to adequately test the device, failing to design, manufacture and assemble the device in a safe manner and failing to warn patients and health care providers of its problem.
An unspecified amount of damages is sought for medical expenses, physical pain and suffering, mental pain and suffering and loss of consortium.
Hubbard is represented by Kevin P. Riche of the New Orleans-based Law Offices of John D. Sileo, LLC.
The case has been assigned to Division H Judge Glenn B. Ansardi.
