Lafon Nursing Home sued over Hurricane Katrina related damages

NEW ORLEANS – A resident of local nursing home claims that she suffered damages as a result of the nursing home failing to transport her from the facility during the course of Hurricane Katrina.

Augustine V. Lumar filed a lawsuit against Lafon Nursing Facility of The Holy Family Inc. and its insurers in the Orleans Parish Central District Court. Lumar claims that despite the warning to leave the New Orleans due to the approach of Hurricane Katrina, the defendant failed to evacuate her or any other resident of the facility. As a result, the facility remained in operation without backup electrical power on premises during the hurricane. Lumar claims to have been exposed to dangerous conditions such as extreme heat temperatures which affected her health.

The defendant is accused of failure to timely transport petitioner before, during or after the hurricane, failure to provide adequate medical care and failure to maintain sufficient backup power supply sources on the premises.

An unspecified amount is sought for all damages including mental anguish and medical and hospital expenses.

The plaintiff is represented by Joseph M. Bruno of Bruno & Bruno, LLP.

This case has been assigned to Division I Judge Piper D. Griffin, Chief Judge.
