NEW ORLEANS – An employee of a local Canal Street establishment is accused of pepper spraying a patron without cause or provocation.
Freddy Hernandez-Cruz filed a lawsuit against Canal Latino LLC and Joseph Thomas in the Orleans Parish Central District Court on Dec. 13. Cruz claims that while standing outside the door of the defendant’s establishment, one of its employees, Thomas, sprayed him in the face and eyes with pepper spray for no apparent reason.
The defendant is accused of failing to take into account the safety of others and failing to protect patrons from unreasonable attacks.
An unspecified amount is sought for physical pain and suffering, medical expenses, bodily disability and impairment of psychological functioning.
