GRETNA – A St. Tammany Parish man is suing a local car dealer for injuries he received when an employee backed into him at the car lot.
Gary Mitchell filed suit against Metairie Capital LLC, Veterans Ford, Tom Punch and Tower National Insurance Co. in the 24th Judicial District Court on Jan. 18.
Mitchell claims he standing next to his car with his door open in the parking lot of Veterans Ford located on Veterans Memorial Boulevard in Metairie when Punch, an employee of Veterans Ford, allegedly backed into his door and pinned him against the car.
The plaintiff alleges he received severe and disabling injuries in the incident including damage to his entire body, injury to the head, brain and nervous system, severe and permanent headaches, emotional upset, distress and psychological damages.
The defendant is accused of failing to see what should have been seen, failing to keep a proper lookout, reckless disregard for the safety of others, inattention, negligently backing of a vehicle and violating the rules of the road.
An unspecified amount in damages is sought for medicine, drugs, hospitalization, medical care, lost wages, loss of wage earning capacity, pain and suffering, residual disabilities, mental anguish, emotional upset, distress, psychological sequelae, loss of enjoyment of life, rehabilitation, support care, property damages and loss of use.

The case has been assigned to Division I Judge Nancy A. Miller.
