GRETNA – A New Orleans man is suing a commercial property owner for injuries he claims to have received when an elevator he was riding in fell at the property.
Darryl Eckert filed suit against 8301 West Judge Perez Drive LLC, Sidney Torres III, Kone Inc., Sentinel Insurance Co. and Hartford Insurance Co. in the 24th Judicial District Court on Jan. 18.
Eckert claims he was a patron at 8301 West Judge Perez Drive in Chalmette when he was in the building’s elevator and it malfunctioned and fell with him in it. The plaintiff alleges he received serious and disabling injuries in the fall.
The defendant is accused of failing to provide guests with a safe place to conduct business, failing to warn guests of the dangerous condition of the elevator and failing to properly maintain the premises, particularly the elevator.
An unspecified amount in damages is sought for medical expenses, pain and suffering, mental anguish, loss of wages, loss of enjoyment of life and disability.
Eckert is represented by Brian G. Shearman of New Orleans-based Shearman-Denenea LLC.
The case has been assigned to Division C Judge June Berry Darensburg.
