Woman who fell over chair while exiting a dance floor sues VFW hall

GRETNA – A Jefferson Parish woman is suing a local private club for injuries she claims to have received in a fall over a chair when exiting a dance floor.

Shirley C. Williams filed suit against VFW John McDonough Post 3121 and Nova Casualty Company in the 24th Judicial District Court on Jan. 22.

Williams claims that near midnight on Jan. 21, 2012 she was dancing at a party being held at the John McDonough Post 3121 located at 475 Monroe St. in Gretna when she fell over a chair while exiting the dance floor. The plaintiff alleges she did not know the chair was placed on the dance floor her and that she was injured in the fall.

The defendant is accused of failing to exercise reasonable care to keep its passageways and floors in a reasonably safe condition, maintaining its premises with a condition that presented an unreasonable risk of harm, creating or having constructive notice of a hazardous condition, maintaining its premises with a condition that presented an unreasonable risk of harm, creating or having actual or constructive notice of the hazardous condition, maintaining the premises with insufficient lighting considering the circumstances and intended use of the premises and allowing the premises without sufficient supervision and control.

An unspecified amount in damages is sought for medical expenses, physical pain and suffering, mental pain and suffering, loss of earnings and loss of earning capacity.

Williams is represented by attorney Anthony L. Glorioso of Metairie.

The case has been assigned to Division L Judge Donald A. Rowan Jr.

Case no. 733-065.
