Home healthcare agency sues owners of dilapidated property

NEW ORLEANS – A home healthcare agency is suing the owners of a dilapidated property where multiple sexual assaults and robberies have allegedly occurred, including the assault of one of its home health nurses.

Louisiana Health Care Self Insurance Fund and Concerned Care Home Health Inc. filed a lawsuit against James P. McNamara, Overboard LLC, Tanglewood Partners LLC and XYZ Insurance Company in the Orleans Parish Central District Court on Jan. 23.

The insurer and employer of an unnamed home health nurse who was kidnapped, sexually assaulted and robbed by multiple offenders on the defendants' blighted property claim the defendants are indebted unto each by virtue of the Louisiana Workers Compensation Act.

The defendants are accused of failing to maintain the derelict property, failing to secure the property and failing to protect against criminal activity on the property.

Plaintiffs are seeking compensation for all past, present, and future payments made to or on the behalf of the victimized nurse along with legal interest and attorney's fees.

Alan J. Yacoubian of Johnson, Johnson, Barrios & Yacoubian will represent the plaintiffs in court.

This case has been assigned to Division N Judge Ethel S. Julien.
