GRETNA – A Jefferson Parish woman is suing the owner of a home and its tenant for injuries she claims her daughter received in an incident on a trampoline.
Shalea Bernard, on behalf of her minor daughter, filed suit against Jennifer Knoor, an unknown property owner and their insurers in the 24th Judicial District Court on Jan. 31.
Bernard claims her daughter was playing on a broken trampoline in the backyard of Knoor's rental home located at 105 Four O'Clock in Waggaman when Knoor's daughter pushed Bernard's daughter off the trampoline. The plaintiff alleges her daughter received a broken collarbone in the incident.
The defendants are accused of allowing a dangerous condition to exist in the form of the broken trampoline, failing to repair the trampoline when the defendant knew or should have known that the defects in the trampoline created a hazard and danger, failing to warn or apprise the plaintiff or other users of the danger and hazard presented by the trampoline, failing to place any type of protective barrier over the defective trampoline, failing to rectify a dangerous and hazardous condition, failing to comply with applicable ordinances and regulations, failing to provide a safe mean of entrance and exit for the plaintiff and being careless and negligent under the circumstances.
An unspecified amount in damages is sought for medical treatment, drugs, medicine and incapacitation.
Bernard is represented by Cesar J. Vazquez of the Kenner-based Vazquez Law Firm.
The case has been assigned to Division C Judge June Berry Darensburg.
Case no. 723-447.
