On the Rocks Lounge sues nearby bar owner for allegedly reporting noise violations

GRETNA – A Harvey-based bar is suing the owner of a nearby competitor for allegedly calling the police on them repeatedly for noise violations in order to harm their business.

On the Rocks Lounge LLC filed suit against Elizabeth Burmaster in the 24th Judicial District Court on Jan. 31.

On the Rocks Lounge claims Burmaster owns a bar near its establishment and has called the police numerous times to complain of noise coming from the premises when it hosts DJs on Friday and Saturday nights. The plaintiff alleges the defendant called law enforcement officers not because of loud noise, but to unjustly harm its business.

The defendant is accused of calling a law enforcement agency without a legitimate motive, causing harm, violating good faith and elementary fairness and causing unjustifiable harm.

An unspecified amount in damages is sought for lost income and legal costs and interest.

On the Rocks Lounge is represented by J. Courtney Wilson of Metairie.

The case has been assigned to Division B Judge Cornelius E. Regan.
