GRETNA – A New Orleans woman is suing a local outlet of an international retail company for injuries she claims to have been injured when an employee ran over her leg with shopping carts pushed by an automatic cart machine.
Barbara Rostrup filed suit against Wal-Mart Stores Inc. in the 24th Judicial District Court on Feb. 1.
Rostrup claims she was shopping for school supplies at the Harahan Wal-Mart and was carrying her grandchild in her arms when an employee of the defendant operating an auto-cart machine ran her over. The plaintiff alleges she received injuries to her back, leg, ankle after she was dragged by the machine. Rostrup asserts that a relative grabbed her granddaughter out of her arms as she was being dragged along by the machine.
The defendant is accused of creating a hazardous condition, negligently allowing the auto-cart to abruptly force the row of shopping carts for its stationary location, failing to see what should have been seen, failing to keep a proper lookout, recklessly and carelessly performing a job, failing to maintain a safe way of storing shopping carts and failing to monitor and control the auto-cart machine which resulted in the shopping carts being propelled into the plaintiff.
An unspecified amount in damages is sought for lost wages, medical expenses, physical pain and suffering, mental pain and anguish, permanent physical impairment, disability and loss of enjoyment of life.
