GRETNA – An insurance company is suing a New Orleans construction firm for allegedly catching one of its customer’s homes on fire during repairs stemming from a hail storm.
Southern Fidelity Insurance Company, as legal conventional subrogee of Ernestine Kennedy, filed suit against Construction Management Enterprises and their insurer in the 24th Judicial District Court on Feb. 1.
Southern Fidelity Insurance Company claims Kennedy contracted Construction Management Enterprises to put a new roof on her Marrero home after it suffered damage in a hail storm. The plaintiff alleges one of the defendant’s employees was using a hot torch during roof repairs when the roof caught on fire and the home was damaged.
The defendant is accused of failing to perform repairs in a safe and proper manner, failing to perform the repairs in an appropriate and workmanlike manner, failing to utilize appropriate and required fire extinguishing equipment, failing to ensure employees were properly trained and equipped, failing to take appropriate measures to prevent the fire, failing to properly supervise the work and failing to provide a proper fire watch.
Damages in the amount of $149,233.64 are sought by the plaintiff for repair, replacement and remedial work to be done of the home as well as attorney’s fees.
