GRETNA – A Jefferson Parish woman is suing a local department store for injuries she claims to have received in an accident on their escalator.
Jessica Bordelon filed suit against J.C. Penney Corporation Inc. and Kone Inc. in the 24th Judicial District Court on Feb. 15.
Bordelon claims she was descending the escalator at the Metairie J.C. Penney when her shopping bag became entangled in a mechanism on the escalator that pulled her off her feet and sucked her into the stairs. Bordelon asserts she suffered severe injuries in the incident.
The defendant is accused of failing to warn of known hazardous conditions, failing to maintain the premises free of hazards, failing to inspect the premises for hazardous conditions, failing to properly respond to an emergency on the store premises, failing to guard and protect its customers from embarrassment and ridicule and designing and operating a defective and unsafe escalator.
Damages not in excess of $75,000 are sought by the plaintiff for physical injury, psychological injury, penalties and attorney’s fees.
Bordelon is represented by attorney Thomas E. Campbell of Metairie.
The case has been assigned to Division L Judge Donald A. Rowan Jr.
