Car salesman hit in buttocks and back by co-worker sues

GRETNA – A Jefferson Parish man is suing his former employer and a co-worker for injuries he allegedly received when that co-worker attacked him.

Darren Davis, and wife Edricca, filed suit against Best Chevrolet Inc. and John Oliver in the 24th Judicial District Court on Feb. 20.

Davis claims he was working as a salesman at Best Chevrolet, along with Oliver, when he was closing an auto sale and another customer approached him about purchasing a car. The plaintiff alleges he asked Oliver to close his previous sale while he attended to the new customer. Davis asserts that later on Oliver approached from his back and hit him in the buttocks and back. The plaintiff claims he was injured in the incident.

Oliver is accused of battery and Best Chevrolet is named in the suit because the incident was allegedly primarily employment-rooted, occurred during working hours and occurred on the employer’s premises, the suit claims.

Damages exceeding $50,000 are sought by the plaintiff for aggravation of a lower back condition, pain and suffering, mental anguish, humiliation, medical expenses and a decrease in income.

Davis is represented by Thomas M. Discon of the Mandeville-based Discon Law Firm.

The case has been assigned to Division D Judge Walter J. Rothschild.
