NEW ORLEANS – A Jefferson Parish company is suing the City of New Orleans after its bid for the contract was rejected.
Dynamic Constructors LLC filed suit against the City of New Orleans in the Orleans Parish Civil District Court on March 4. The dispute arises from a bid the company placed for a contract on Phase II of the Milton H. Latter Library renovations. The city rejected the bid on Feb. 5 claiming that the bid was non-responsive to the city’s Disadvantaged Business Enterprise (DBE) program.
Dynamic alleges that it is fully compliant with the DBE. When the company protested its rejection, the city claimed that one of the forms had not been filled out properly. The company says that its personnel specifically sought advice from the city concerning the form in question and followed the advice it received.
The city is accused of wrongfully rejecting Dynamic’s bid for the project because by giving Dynamic advice it is stopped from rejecting the bid due to non-conformance.
The plaintiff is asking that the court order the city to award it the contract.
