Suit against Brother’s Food Mart claims grease caused slip

NEW ORLEANS – A New Orleans woman is suing a local gas station and food mart after allegedly falling on its premises.

Yvonne Ervin filed a lawsuit against Brother's Carondelet LLC and Brother’s Food Mart in the Orleans Parish Central District Court on Feb. 19.

Ervin alleges that upon her entrance into the defendant's establishment she slipped and fell on a grease on the floor inside the store resulting in disabling injuries to her leg and back.

The defendant is accused of failing to properly maintain and clean the area where the incident occurred, failing to use reasonable care and failing to warn of the unreasonable and dangerous condition.

An unspecified amount is sought for pain and suffering, mental anguish, medical expenses and loss of enjoyment of life.

Attorney A.J. Rebennack of Metairie will represent Ervin in court.

This case has been assigned to Division F Judge Christopher J. Bruno.

Case no. 2013-01520.
