GRETNA – A St. Bernard Parish man is suing the owner of a dump truck claiming that after it struck an overhead power line its tire exploded and fragments hit him and caused severe injuries to his body.
Adrian Bendich filed suit against Technology Insurance Company Inc., Michael Davis and Mason’s Truck Service LLC in the 24th Judicial District Court.
Bendich claims he was standing next to a dump truck owned by Mason’s Truck Service and operated by Davis when it engaged its dump bed which struck an overhead power line as it was rising and caused electricity to course through the truck and blow out one of its tires. The plaintiff alleges that he was struck in the groin area by pieces of the tire when it exploded. Bendich asserts the injuries he received in the incident were serious and gruesome.
The defendant is accused of allowing the dumping bed to come into contact with an overhead power line, failing to move the dump truck to an open space away from the plaintiff, failing to warn the plaintiff to move away from the truck and failing to maintain responsibility and proper control of the vehicle.
An unspecified amount in damages is sought for physical pain and suffering, mental pain and suffering, medical care, expense of transportation to and from health care providers, loss of earnings, impaired earning capacity, loss of enjoyment of life and feelings of economic insecurity.
Bendich is represented by Glenn Lieberman of New Orleans-based Morris Bart LLC.
The case has been assigned to Division B Judge Cornelius E. Regan.
